On December, 17th the European Parliament approved the unified system of patents in Europe, in order to protect inventions in 25 States of the Union with a single legal document. For the moment, Italy and Spain, questioning the choice of English, German and French as the only compulsory languages, remain (for now) not included. The first consequence of the Community patent is a clear bureaucratic and administrative simplification, and therefore a significant cost cutting (estimated savings of up to 80%).
The Ministry of Economic Development confirms the availability for 2013 (until depletion) for the premiums incentives allocated for small and medium-sized enterprises patenting in Italy or abroad. There is still a total of 25 million Euros to be delivered. To file the request, one just needs to have filed after January 1st, 2011 a patent application having a positive Italian search report or to have asked substantive examination at the EPO or WIPO for foreign applications.
As of September 4th, 2012, the applicants of Community trademark applications or registrations, and/or International registrations, may submit to the Economic Development Ministry an application for facility to request a refund for trademark filing fees, expenses for prior titles researches and specialist advice relating thereto. For Community Trademarks a refund is expected up to 80% of eligible costs, with a ceiling of 4,000 Euros for each application filed at the Community Office. For International registrations a refund is expected equal to 80% of the costs for fees, searches for prior titles and expert advice. In the event that, among the States selected for registration, there are China and/or Russia, such reimbursement will be equal to 90%.
